If you have not checked out on GunBroker within three days, and we have not received any communication from you, we will assume you are not able to complete the transaction and will re-list the item.

Where We Ship Firearms

WE SHIP FIREARMS TO ALL US STATES, INCLUDING CALIFORNIA. If you need shipment to Alaska or Hawaii, select the correct shipping option when checking out. We do NOT ship to Puerto Rico, Guam, or other US Territories.

IMPORTANT BEFORE YOU BUY: Make sure your FFL will receive the firearm for you. Show your FFL the firearm you plan to own. If they confirm that they will receive it for you, go ahead and make the purchase. If your FFL does not receive the firearm for you for any reason and it gets returned to us, it will be subject to a restocking charge as outlined under Returns.


Buying an NFA Weapon

First, all NFA rules apply and it’s good to familiarize yourself with the National Firearms Act if you plan to own an NFA weapon. To purchase an NFA item, your receiving FFL must also be a Class 3 SOT (NFA) dealer. It’s easy to find a Class 3 dealer, but many FFLs don’t handle NFA weapons, so be sure to ask. We will need your receiving FFL to email a copy of their license and SOT to us at: FFL@firearmland.com. After you pay for the item, we will file ATF Form 3, transferring the item from us to your FFL. This form is usually approved by ATF in 1-2 weeks. When the item arrives at your FFL, you will be able to file ATF Form 4 which will transfer the item to you. Returns & Cancelled Orders

We guarantee that your order will be delivered as described. We offer a three-day inspection period to ensure your expectations have been met. If you experience an issue with your order, please contact us at sales@firearmland.com so we can help. We care about your satisfaction and will do what we can to make the situation right.

If your order must be returned for other reasons, such as an inability to take legal possession of a firearm, please note that such returns are subject to a 25% restocking charge. This charge is needed to offset the significant costs associated with returning such an item to inventory.

Sometimes, we understand that orders must be cancelled. If you need to cancel your order, contact us at sales@firearmland.com. Upon approval and payment of a 15% restocking charge, we will cancel your order and ask GunBroker not to take action against your account.

While every effort is made to accurately describe the condition of each Product, the Seller does not test-fire any firearms, nor conduct any testing of ammunition for performance, reliability, or safety. The Seller provides this information to the best of its ability based solely on a visual inspection, and makes no guarantees regarding the operational functionality, safety, or reliability of the Product beyond what is visible to the eye. The Buyer expressly acknowledges that the Seller and its representatives are not responsible for any defects, latent or otherwise, that may exist in the Product, including but not limited to defects that could result in serious injury, disability, or death. By proceeding with the purchase, the Buyer agrees to have the firearm inspected by a qualified, licensed, and competent gunsmith prior to any use. Failure to do so transfers all responsibility for any potential malfunction, injury, or damage resulting from the use of the firearm to the Buyer. The Seller shall not be held liable for any damages arising from the Buyer’s failure to follow this recommendation or from any issues discovered during such an inspection. It is strongly recommended that a qualified gunsmith or armorer thoroughly inspect the Product prior to use, especially in the case of used or vintage firearms.

 

2. Assumption of Risk:
By bidding on, purchasing, or accepting transfer of any firearm, ammunition, or related item (“Product”) from FirearmLand (“Seller”), the Buyer expressly acknowledges and agrees that the use or misuse of firearms and ammunition carries inherent risks, including but not limited to serious injury, disability, death, and property damage. These risks exist regardless of the condition of the Product, and the Buyer voluntarily assumes full responsibility for these risks.

3. No Warranty – Sold “As Is”:
All Products are sold “AS IS” and “WITH ALL FAULTS”. The Seller makes NO REPRESENTATIONS OR WARRANTIES, express or implied, concerning the safety, quality, or suitability of any Product for any purpose. The Seller expressly disclaims all implied warranties, including but not limited to the implied warranties of merchantability and fitness for a particular purpose.

4. Buyer’s Due Diligence and Responsibility:
It is the Buyer’s sole responsibility to ensure that the Product is legal to own and possess in their jurisdiction. This includes, but is not limited to, ensuring compliance with federal, state, and local laws regarding firearm and ammunition ownership. Prior to use, the Buyer must have the Product inspected and certified as safe by a qualified, licensed, and competent gunsmith or armorer. The Buyer assumes all responsibility for the safe handling, use, storage, and transportation of the Product.

5. Limitation of Liability:
To the fullest extent permitted by law, the Buyer agrees to indemnify, defend, and hold harmless the Seller, its owners, affiliates, officers, directors, employees, agents, and assigns from any and all claims, damages, losses, liabilities, costs, and expenses (including attorney’s fees) arising out of or related to the purchase, ownership, possession, use, misuse, or malfunction of the Product. The Seller shall not be liable for any direct, indirect, incidental, consequential, special, punitive, or exemplary damages arising from or related to the sale, transfer, use, or misuse of the Product, even if advised of the possibility of such damages.

6. Release of Liability and Agreement to Pursue Other Parties:
By proceeding with the purchase, the Buyer releases the Seller from any and all liability, whether arising under contract, tort (including negligence), strict liability, or any other theory of liability, for any injuries, damages, or losses of any kind arising from or related to the Product. The Buyer expressly agrees that in the event of a claim, lawsuit, or legal action arising from or related to the Product, the Buyer will first pursue remedies against any third parties involved in the production, manufacturing, distribution, sale, or repair of the Product, including but not limited to the manufacturer, previous owners, or service providers, before initiating any action against the Seller. This agreement is made to the fullest extent permitted by law.

7. No Liability for Defects:
The Seller is not responsible for any defects, latent or otherwise, in the Product, including but not limited to manufacturing defects, design defects, or any damages resulting therefrom. The Buyer acknowledges that they are purchasing a Product that may have unknown faults and that the Seller cannot be held liable for any issues that arise after the sale, particularly in relation to used or pre-owned Products.

8. Legal Compliance:
The Buyer agrees to comply with all terms outlined in this listing and set forth by GunBroker.com. The Buyer certifies that they are legally eligible to purchase and possess the Product and that they are not prohibited by federal, state, or local laws from owning firearms or ammunition. The Seller makes no representations regarding the legality of the Product in the Buyer’s jurisdiction.

9. Governing Law and Jurisdiction:
This agreement shall be governed by and construed in accordance with the laws of the State of [Your State], without regard to its conflict of law principles. Any disputes arising from this agreement or the purchase of the Product shall be resolved exclusively in the state or federal courts located in [Your County and State], and the Buyer consents to the personal jurisdiction of such courts.
